Is Surgery Only Solution For Painful Stitch After Appendix Surgery?

Back in 2001 my appendix burst and I had to have emergency surgery. Now I have what I do believe it a staple poking out right beside of my belly button. I recently got medical insurance and went to a primary care provider. My pcp also thought that it was a staple and requested my medical records from the hospital and contacted that doctor that did my surgery. I was upset with an appointment to see him which was today. He told me that he remembers doing my surgery and says that it is a plastic stitch knot and he wanted to cut me open and remove it right then and there. He then told me that if he removed it I could have a hernia. After I told him that I didn't want him to cut me today he set me up with an apointment for surgery Monday oct. 11. He claims this is nothing serious but if that was the case then why is my surgery scheduled so soon and why did this even get let inside my body? I really think it is a metal staple but I'm not sure I know it is very painful to touch. Should I go and have the surgery or should I get a second opinion. Is this malpractice? I don't really want a doctor to work on my that already messed up. Should I contact a lawyer? What should I do? please help asap
